Acceptable Use Policy
Effective date: October 19, 2026
This Acceptable Use Policy ("AUP") is part of the Cullektor Terms of Service. It applies to every customer, partner and user, and to every message sent through Cullektor, whether drafted by you, by our AI or by our Desk team. Cullektor is operated by Cullektor (legal entity registration in progress).
The short version: business invoices only, tell the truth, be respectful, and respect "stop".
1. Business-to-business receivables only
You may use Cullektor only to follow up on amounts genuinely owed to your business by other businesses for goods or services you supplied. You must not use Cullektor to:
- collect or follow up on any consumer debt, meaning money owed by an individual primarily for personal, family or household purposes (this is the kind of debt covered by the federal Fair Debt Collection Practices Act);
- collect medical or healthcare receivables, residential rent, homeowner or HOA dues, utility bills, student loans, payday or personal loans, or any receivable owed by an individual in a personal capacity;
- collect debts you have bought, or debts owned by anyone other than you (unless you are an approved reseller partner acting for your own clients, each of which owns its receivables);
- collect amounts you know or should know are not owed, are disputed and unresolved, have been discharged in bankruptcy, are time-barred, or include fees, interest or charges that are not authorized by your contract or the law; or
- pursue a guarantor or business owner personally, or a lender's or commercial-finance provider's debts, unless we have agreed to it in writing (some states regulate these collections like consumer debts).
2. Honest communications
Every message must be truthful and not misleading. You and your messages must not:
- misrepresent the amount, status, age or legal character of a debt;
- pretend to be, or imply involvement of, an attorney, court, government agency, credit bureau or collection agency;
- use fake names, fake departments or invented deadlines, or claim that a message is from a person when it is not, or vice versa, in response to a direct question;
- disguise who the creditor is. Messages go out in your company's name. Desk personnel communicate as members of your AR team and, if asked, will truthfully say they are part of an outsourced AR team working for your company;
- use deceptive subject lines, misleading "from" names or spoofed sending domains; or
- send "pay or else" messages that threaten actions you do not intend or are not legally entitled to take.
3. No harassment, threats or abuse
You and your messages must not:
- threaten violence, criminal prosecution, arrest, damage to reputation, or contact with the debtor's customers, employer or family;
- use obscene, profane, abusive, discriminatory or demeaning language;
- contact people at unreasonable times or with unreasonable frequency. Cullektor applies quiet hours and weekly touch limits, which you must not set aside to harass;
- publicly shame a debtor, including on social media or "bad payer" lists; or
- contact anyone who has asked not to be contacted, except to confirm the request or as required by law.
4. Email rules (CAN-SPAM and good practice)
Reminder emails about an existing invoice are generally transactional, but any email that promotes your products or services is commercial. Whatever their type, you must:
- send only from domains and mailboxes you own and control, with accurate header and routing information;
- use accurate subject lines;
- for any commercial content, include a clear way to opt out and your valid physical postal address, and honor opt-out requests within 10 business days;
- not send to purchased or scraped lists, or use Cullektor for cold outreach, marketing campaigns or newsletters; and
- meet mailbox-provider sender requirements (for example SPF, DKIM and DMARC) for your domain.
5. Calls and text messages (TCPA)
Cullektor does not send SMS or make automated calls today. If we add those features, or if the Desk makes calls on your behalf:
- calls are made by people, to business telephone numbers you provide, during the recipient's business hours;
- no autodialers, prerecorded or artificial (including AI-generated) voice messages, or text messages may be sent to any mobile number without the recipient's prior express consent (and prior express written consent for any marketing), as required by the Telephone Consumer Protection Act and FCC rules;
- you must give us only numbers you have the right to call, and tell us promptly about opt-outs, revoked consent and reassigned numbers; we will honor any request to stop calls or texts, made by any reasonable means;
- calls are not recorded unless you and we have agreed to it and all-party consent is obtained where state law requires it.
6. Data and security
You must not upload data you do not have the right to share, special-category or sensitive personal data not needed for invoicing, or malware. You must not try to access other customers' data, probe or bypass our security or usage limits, or scrape the Service.
7. Partners and resellers
Partners must ensure each client they onboard meets this AUP, accepts terms at least as protective as our Terms of Service, and has authorized the partner to act for it.
8. Enforcement
We may review messages, templates and settings to enforce this AUP. We may refuse to send a message, pause a sequence, suspend an account or terminate the Terms if we reasonably believe this AUP has been breached, as set out in the Terms. Report suspected misuse to hello@cullektor.com. If you received a message sent through Cullektor and want it to stop, reply "stop" to the sender or email us, and we will make sure the sender is told and further automated follow-up stops.
